Andy Hayher of our office was successful in having an appeal dismissed at Alberta’s highest court. Andy acted for the Respondent father in an appeal related to what jurisdiction a mobility/custody trial should be held in. The Appellant mother’s position was that Ontario was the appropriate jurisdiction while the Respondent father’s position was that Alberta was the correct jurisdiction. We were successful at the Court of Queen’s Bench where Madam Justice K.D. Nixon ruled that Alberta was the correct jurisdiction. The Appellant mother appealed. Her appeal was unanimously dismissed by the Alberta Court of Appeal. The written reasons for judgment are available at this link.
